These Terms and Conditions ("Terms") govern access to and use of FuoriSerie, an adult-only automotive community application provided by CDR APPS DI RUSU COSMIN DUMITRU ("CDR Apps", "we", "us", or "our").

1. Acceptance of these Terms
You may use FuoriSerie only after accepting the current version of these Terms and the current FuoriSerie Community Rules when acceptance is required by the service.
The Privacy Policy is provided separately as a privacy notice. Acceptance of these Terms does not constitute consent to processing that, under applicable law, requires a separate legal basis or separate consent.
Where FuoriSerie requires renewed acceptance after a material Terms or Community Rules update, access to affected functionality may remain blocked until the current required versions have been accepted.
2. Adult-only service
FuoriSerie is strictly for people aged 18 years or older.
You must not register for, access, or use FuoriSerie if you are under 18. You must provide truthful age-eligibility information. CDR Apps may restrict or terminate an account where it reasonably determines that the account holder is under 18 or has circumvented an age-eligibility control.
FuoriSerie is not designed, directed, or marketed to children.
3. Closed-testing status
This version of FuoriSerie is distributed for pre-release closed testing. Features may be incomplete, unavailable, changed, removed, or activated progressively during the testing period.
The closed-testing version is currently provided without an active paid-subscription purchase flow. Subscription capability tiers may exist in the software architecture for feature-control purposes, but these Terms do not represent that paid subscriptions are currently available for purchase.
Before any paid subscription or other paid digital service is offered, CDR Apps will provide the legally required pre-contract information and update the applicable terms and purchase disclosures. Mandatory consumer rights remain unaffected.
4. Accounts and security
FuoriSerie may require an authenticated account, a verified email address, and an active backend account status.
You are responsible for:
- providing accurate account information;
- maintaining control of your credentials and connected sign-in providers;
- using your own account rather than impersonating another person;
- promptly notifying CDR Apps if you reasonably believe your account has been compromised; and
- complying with account-security and integrity checks used by the service.
Account roles and subscription capabilities are separate. A role, subscription, badge, status, or other in-app label does not exempt any user from these Terms, the Community Rules, safety requirements, or applicable law.
5. What FuoriSerie provides
FuoriSerie is a digital automotive community service. Depending on the release state and features enabled for your account, it may provide functionality such as:
- a personal Garage and vehicle-related records;
- vehicle photos, build journals, modifications and specifications;
- public profiles and optional public profile information;
- creation or viewing of user-generated content;
- Clubs and Meets functionality;
- user reporting and blocking;
- moderation and appeal-related functionality;
- account and subscription-capability controls; and
- policy and account-management functionality.
Some Garage, media, Club, Meet, or draft data may remain local to your device unless a feature clearly indicates that information is being published, uploaded, synchronized, or otherwise made available through a cloud-backed feature.
CDR Apps provides the digital service. It does not certify users, vehicles, modifications, events, or real-world conduct.
6. Vehicles, modifications and real-world conduct
You are solely responsible for your own vehicle, modifications, maintenance, use, insurance, registration, inspections, roadworthiness, homologation, approvals, permits, and compliance with applicable law.
Nothing displayed on FuoriSerie is a legal, technical, safety, insurance, ownership, roadworthiness, homologation, registration, or regulatory certification.
In particular:
- a vehicle appearing in a user's Garage does not prove legal ownership;
- a user statement about a vehicle or modification does not prove that it is lawful or road-legal;
- a badge, role, subscription level, profile status, Club role, Meet role, or other platform label is not a government, manufacturer, insurer, inspection-body, or CDR Apps certification of a vehicle; and
- information shared by users must not be relied upon as a substitute for professional, legal, mechanical, insurance, or regulatory advice.
You must comply with road-safety laws and all other applicable rules wherever you drive or use a vehicle.
7. No support for illegal or dangerous activity
CDR Apps and FuoriSerie do not organize, promote, endorse, encourage, authorize, or support illegal street racing, reckless or dangerous driving, police evasion, unlawful vehicle modifications, road obstruction, unsafe burnouts, dangerous Meets, theft, trafficking in stolen vehicles or parts, fraud, or any other unlawful conduct.
Users remain responsible for their own conduct, content, vehicles, decisions, and compliance with law.
FuoriSerie must not be used to plan, coordinate, facilitate, recruit for, glorify, or materially encourage unlawful or seriously dangerous activity. Detailed restrictions are set out in the Community Rules.
CDR Apps may restrict content or accounts and may take other proportionate action where unlawful or dangerous activity is reported or identified. Nothing in these Terms limits obligations that CDR Apps cannot lawfully exclude.
8. Clubs, Meets and offline events
Where Clubs or Meets functionality is enabled, use of FuoriSerie to create, describe, share, join, or manage a Club or Meet does not by itself make CDR Apps the organizer, promoter, host, venue operator, security provider, transport provider, insurer, or supervisor of the real-world activity.
Unless CDR Apps expressly identifies itself as the organizer of a specific event, the relevant organizers and participants are responsible for:
- lawful organization of the event;
- venue permission and any public-authority authorization;
- traffic and road-safety compliance;
- insurance and any legally required coverage;
- crowd and participant safety;
- lawful vehicle use;
- compliance with local rules; and
- cancelling or changing plans when conditions are unsafe or unlawful.
No FuoriSerie feature authorizes conduct that would otherwise be illegal.
9. User-generated content
"User Content" means information, text, usernames, profile material, photographs, videos, vehicle information, posts, reports, Club or Meet content, and other material that a user submits, publishes, shares, or makes available through a FuoriSerie feature.
You retain ownership of rights you hold in your User Content.
By submitting User Content to a cloud-backed or public FuoriSerie feature, you grant CDR Apps a non-exclusive, worldwide, royalty-free licence, with the right to permit its service providers to process the content, only to the extent reasonably necessary to:
- host, store, format, transmit, reproduce and display the content according to your feature and visibility choices;
- operate and secure FuoriSerie;
- create technical copies and backups;
- prevent abuse and investigate reports;
- moderate content and enforce these Terms or the Community Rules; and
- comply with applicable legal obligations.
This licence does not transfer ownership of your content to CDR Apps. It ends when the content is deleted from the service, subject to reasonable technical backup cycles and lawful retention requirements.
You must have the necessary rights and permissions for content you submit. You must not upload content that infringes another person's copyright, trademark, privacy, image rights, confidentiality, or other legal rights.
10. Public profiles and location information
Where public-profile functionality is enabled, information you intentionally make public may be visible to other FuoriSerie users.
A public profile may include a public username and, where provided, display name, biography, avatar, country code, city, and discoverability status.
Country and city information are coarse location information and must be shared only through the user's explicit profile choice. Do not publish another person's private address or precise location without a lawful basis and their appropriate permission.
11. Community Rules and prohibited content
The FuoriSerie Community Rules form part of the rules governing use of the service.
Among other things, FuoriSerie prohibits content or conduct involving:
- child sexual abuse or exploitation, child sexual abuse material, grooming, sexual extortion, or trafficking;
- pornography or unlawful sexual content;
- credible threats, violence, harassment, bullying, hateful conduct, or targeted abuse;
- doxxing or publication of another person's private or sensitive information;
- impersonation;
- fraud, scams, phishing, malware, deceptive links, fake promotions, or abusive fake engagement;
- stolen vehicles or parts, illegal goods, or criminal coordination;
- illegal street-racing coordination or material encouragement of dangerous driving;
- road blocking, dangerous burnouts around people, or unsafe Meet conduct;
- infringement of copyright, trademark, or other intellectual-property rights;
- knowingly false claims of ownership, legality, roadworthiness, insurance, homologation, tuning approval, or certification; and
- spam or abusive commercial activity.
The Community Rules contain the fuller standard and should be read before publishing content.
12. Reporting, blocking and illegal-content notices
Where an in-app reporting or blocking control is available, users should use it for the relevant profile, user, or content.
For a report of potentially illegal content where an in-app control is not available or additional information is needed, contact [email protected]. A useful notice should identify the content or account clearly, explain why it is believed to be illegal or prohibited, and provide enough information for CDR Apps to locate and assess it.
CDR Apps may ask for additional information when reasonably necessary. Reports are assessed diligently and proportionately based on the information available.
Knowingly submitting fabricated, abusive, or bad-faith reports may itself violate the Community Rules.
Nothing in this section replaces emergency services. Where there is an immediate threat to life or physical safety, contact the competent emergency or law-enforcement authority.
13. Moderation and enforcement
CDR Apps may use technical controls and human review, as appropriate to the relevant feature, to enforce the service rules and protect users and the platform.
Potential measures include:
- rejecting or limiting an operation before publication;
- reducing visibility or disabling access to content;
- removing content;
- restricting a feature;
- warning a user;
- temporarily suspending an account;
- permanently disabling an account; or
- preserving or disclosing information where required by applicable law.
The measure chosen may depend on severity, context, recurrence, credible risk, applicable law, and the information reasonably available to CDR Apps.
Where applicable law requires CDR Apps to provide an affected user with reasons for a content or account restriction, CDR Apps will provide a clear and specific explanation using the available electronic contact channel, subject to lawful exceptions.
Where an appeal or review mechanism is available for the relevant decision, the affected user may use it according to the instructions provided with that decision.
CDR Apps does not undertake a general obligation to monitor every item submitted by users. However, it may investigate reports and may take voluntary safety or moderation measures consistent with applicable law.
14. Child sexual abuse and exploitation
FuoriSerie is 18+, but CDR Apps applies a zero-tolerance standard to child sexual abuse and exploitation ("CSAE") and child sexual abuse material ("CSAM").
Users must never create, upload, request, distribute, advertise, link to, facilitate, normalize, or solicit CSAE or CSAM, including grooming, sexual extortion of a child, sexual trafficking of a child, or attempts to obtain sexual material involving a child.
CDR Apps may remove such material, restrict accounts, preserve relevant evidence where legally permitted or required, and report confirmed or suspected material or conduct to competent authorities or legally designated reporting bodies as required by applicable law.
15. Intellectual property of FuoriSerie
FuoriSerie, the FuoriSerie name and branding, CDR Apps branding, application software, interface design, graphics and other CDR Apps-owned materials are protected by applicable intellectual-property laws.
Subject to these Terms, CDR Apps grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the app for its intended purpose.
You may not copy, sell, sublicense, reverse engineer where prohibited by law, interfere with, exploit, or misuse the service except as permitted by mandatory law or with CDR Apps' written authorization.
16. Service integrity
You must not:
- bypass authentication, age, App Check, policy, account-status, subscription, or feature controls;
- probe or exploit security vulnerabilities;
- automate abusive account creation, scraping, posting, reporting, or other operations;
- access another user's non-public information without authorization;
- interfere with the service or its infrastructure; or
- misuse identifiers, APIs, or technical interfaces.
CDR Apps may use integrity and abuse-prevention controls to protect the service.
17. Account deletion and termination
Where account deletion is available, users may request or initiate deletion through the available FuoriSerie account-management flow.
Deletion is designed to remove or de-identify account-linked service data within the applicable product architecture. Some limited information may be retained where necessary for:
- compliance with a legal obligation;
- establishment, exercise, or defence of legal claims;
- safety, fraud, abuse or moderation investigations;
- prevention of impersonation or abusive re-registration, using minimal data where feasible; or
- completion of technically necessary backup deletion cycles.
CDR Apps may suspend or terminate access where these Terms, the Community Rules, safety requirements, or applicable law are violated. Mandatory consumer rights remain unaffected.
18. Service availability and changes
FuoriSerie may be changed to improve safety, security, functionality, legal compliance, or product quality.
During closed testing, interruptions, feature changes and test-only limitations are especially likely.
CDR Apps does not guarantee uninterrupted or error-free availability. This does not limit any mandatory statutory conformity or consumer remedy that applies to the digital service.
Material changes to these Terms will be communicated through an appropriate service or contact channel. Where renewed acceptance is required, FuoriSerie may require acceptance of the new version before affected functionality can continue.
19. Paid services and consumer rights
No paid subscription purchase is active in this closed-testing version.
If paid digital services are introduced, CDR Apps will disclose the applicable price, billing period, renewal and cancellation conditions, service characteristics, trader information, and other legally required information before the user is bound by the purchase.
Any statutory withdrawal right, legal guarantee of conformity, price-reduction right, termination right, refund right, or other mandatory consumer remedy that applies under Italian or EU law is not excluded by these Terms.
Any future Google Play purchase will also be subject to the applicable Google Play billing and purchase framework, without reducing rights that cannot legally be waived.
20. Responsibility and limitation of liability
Users are responsible for their own User Content, vehicles, modifications, driving, real-world activities, Clubs, Meets, statements, transactions, and compliance with law.
To the maximum extent permitted by applicable law, CDR Apps is not responsible merely because FuoriSerie is used as the technical service through which a user publishes information, communicates, organizes an activity, or describes a vehicle.
CDR Apps does not endorse user content or conduct and does not guarantee the truth, legality, safety, ownership, roadworthiness, insurance, homologation, quality, or reliability of user-provided information.
Nothing in these Terms:
- excludes or limits liability where exclusion or limitation is prohibited by law;
- removes mandatory consumer rights;
- removes CDR Apps' obligations under applicable privacy, digital-services, consumer, or other law; or
- limits liability for conduct for which liability cannot lawfully be limited.
21. Applicable law and disputes
These Terms are governed by Italian law, without depriving a consumer residing in another country of mandatory protections that apply to that consumer under applicable law.
For consumers, any mandatory rules on competent courts and consumer jurisdiction remain unaffected.
Before starting a dispute, users are encouraged to contact [email protected] so that CDR Apps can attempt to resolve the issue.
